Terms of Business
Risecap Ltd is an independent funding partner registered in England and Wales (company number 11203916). We help UK businesses secure commercial finance by matching your requirements with suitable lenders from our network. We are not a lender. When you engage Risecap, we will assess your business funding requirements through an initial consultation, review and analyse the financial documents you provide, identify suitable lenders and funding products from our network, prepare and submit applications to selected lenders on your behalf, manage lender communications and negotiate terms where possible, and keep you informed of progress throughout. We do not provide financial, tax, or legal advice, do not guarantee funding will be secured, do not act as a lender, and do not make investment recommendations.
To enable us to provide our service effectively, you agree to provide accurate, complete, and truthful information and documentation, inform us promptly of any material changes to your circumstances or financial position during the application process, respond to requests for additional information in a timely manner, not approach lenders we have introduced directly bypassing our involvement, and pay our fees as set out below.
We use a combination of human expertise and AI-assisted technology to analyse the financial documents you provide. This includes automated extraction of financial data, AI-assisted credit assessment and scoring against lender criteria, and automated document completeness checking. All AI-assisted analysis is reviewed by a qualified member of our team before any decisions are made or applications submitted. No fully automated decisions are made about your funding application. You have the right to request that your documents are analysed without AI assistance (this may result in longer processing times), request a full explanation of any AI-assisted analysis, and challenge any assessment and request human review. Our fee is payable only upon successful completion of funding. This means you do not pay us unless and until a lender has provided you with a formal offer which you have accepted and funds have been drawn down. Our fee is calculated as a percentage of the total funding amount secured, confirmed to you in writing before we begin work. There are no upfront fees, application fees, or charges for unsuccessful applications. Fees become payable upon drawdown of funds and invoiced with 14-day payment terms.
Where we have introduced you to a lender, you agree not to approach that lender directly (bypassing Risecap) for a period of 12 months from the date of introduction. If you proceed with funding from an introduced lender without our involvement during this period, our full fee remains payable.
We will use our best efforts to identify suitable funding but do not guarantee any lender will approve your application. We have no control over lender decisions, timescales, or terms. Our total liability shall not exceed the fees paid to us for the specific transaction. We are not liable for loss of anticipated funding, indirect or consequential losses, delays caused by third parties, or losses from inaccurate information provided by you.
You may terminate our engagement at any time by giving us written notice. If funding has already been secured through our introduction prior to termination, our fee remains payable. We may terminate if you provide materially inaccurate information, fail to provide requested documents within a reasonable timeframe, we determine we are unable to assist, or you breach these terms.
If you are dissatisfied with any aspect of our service, contact us at complaints@risecap.co.uk. We will acknowledge your complaint within 3 working days and provide a full response within 15 working days. If unresolved, you may escalate to the Information Commissioner's Office at www.ico.org.uk or 0303 123 1113.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts. These terms, together with our Privacy Policy, constitute the entire agreement between you and Risecap in relation to our services. We may update these terms from time to time. Continued engagement following any update constitutes acceptance of the revised terms.
